The terms “we”, “us” and “our” refer to MIUUR, a trading name operated by Ignacio Cristofori. MIUUR operates this online store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).

MIUUR is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services or purchase products from MIUUR.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, or by placing an order with MIUUR, you agree to be bound by these Terms of Service and our Privacy Policy.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable law.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your country or place of residence, or that you have obtained any consent required by applicable law.

To use certain Services, including placing an order, you may be asked to provide information such as your name, email address, billing information, payment information, telephone number and shipping address.

You agree that all information you provide is accurate, current and complete and that you have the right to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

Customer accounts are provided for your personal use and may not be transferred, sold, assigned or licensed to another person.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to display and describe our products as accurately as possible.

However, colours and product appearance may vary slightly depending on the device, screen, settings or lighting conditions used to view the website.

Because many MIUUR products are made using natural materials and artisanal processes, minor variations in colour, grain, texture, finish or construction may occur. These variations are characteristic of the materials and craftsmanship and are not necessarily defects.

Product descriptions, specifications, availability and prices may be updated or changed without notice.

We reserve the right to discontinue products and to limit the quantities available for purchase where reasonably necessary.

Pre-orders

Certain products may be offered for pre-order before they are available for immediate shipment.

Where a product is sold on a pre-order basis, an estimated shipping date or period will be displayed on the product page or during checkout.

Payment for pre-orders may be collected at the time the order is placed.

Any shipping date communicated for a pre-order is an estimate. Production, logistics, customs or other circumstances outside our reasonable control may affect the estimated shipping date.

If there is a material delay to a pre-order, we will make reasonable efforts to inform you using the contact details provided with your order.

Nothing in this section affects any mandatory consumer rights available to you under applicable law.

SECTION 3 – ORDERS

When you place an order with MIUUR, you are making an offer to purchase the products included in your order.

Your order is subject to acceptance by MIUUR.

We may decline or cancel an order where reasonably necessary, including in cases of product unavailability, pricing or product information errors, suspected fraud, payment problems or circumstances preventing us from fulfilling the order.

Payment must be successfully authorised and processed before an order can be completed.

Please review your order carefully before submitting it.

Cancellation requests submitted before an order is fulfilled will be considered by MIUUR where operationally possible. However, we cannot guarantee that an order can be cancelled once it has entered preparation, production or fulfilment.

This does not affect any statutory right of withdrawal or other mandatory consumer right that may apply to you.

If we decline, materially modify or cancel an order, we will make reasonable efforts to notify you using the email address or other contact information provided with your order.

Products purchased through our online store are intended primarily for personal use and not for unauthorised commercial resale.

SECTION 4 – PRICES, TAXES AND BILLING

Prices, discounts and promotions may change without notice.

The price applicable to your order will be the price displayed and confirmed during checkout at the time the order is submitted.

MIUUR sells internationally and pricing may vary depending on the customer’s country or market.

Where stated on the website or during checkout, applicable taxes and duties are included in the price charged to the customer.

Any shipping charges that apply to an order will be clearly displayed before the order is completed.

MIUUR currently offers free worldwide shipping on orders over €350. For orders below €350 outside Spain, shipping charges may vary depending on the destination and shipping method selected. Current shipping conditions and available delivery options are displayed on the website and during checkout.

Promotions and discount codes may be subject to separate terms and conditions.

If promotional terms conflict with these Terms of Service, the specific promotional terms will apply to that promotion.

You agree to provide current, complete and accurate purchase, payment and account information.

You represent that you are authorised to use any payment method submitted in connection with an order.

SECTION 5 – SHIPPING AND DELIVERY

MIUUR ships orders to the destinations made available during checkout.

Available shipping methods and any applicable shipping charges will be displayed during checkout.

Delivery dates and transit times are estimates only unless expressly stated otherwise.

MIUUR is not responsible for delays caused by circumstances outside our reasonable control, including carrier disruptions, customs procedures, adverse weather, strikes or other logistical events.

Where taxes and duties are stated to be included, MIUUR will arrange the shipment in accordance with the terms displayed at checkout.

Customers are responsible for providing a complete and accurate delivery address and contact telephone number.

Risk of loss or damage to products passes to the customer when the order is delivered to the customer or to a person designated by the customer, subject to applicable consumer law.

SECTION 6 – RETURNS AND REFUNDS

Unless otherwise stated for a particular product and subject to applicable consumer legislation, eligible products may be returned within 14 days starting from delivery of the last item in the relevant order.

Products must be returned unused, unworn and in their original condition, with all original packaging, labels and accessories.

For eligible returns from mainland Spain and the Balearic Islands, MIUUR offers complimentary return shipping.

For returns from all other destinations, unless the product is defective, incorrect or otherwise subject to a mandatory legal remedy, the customer is responsible for arranging and paying the cost of returning the product to MIUUR.

No restocking fee is charged for eligible returns.

Original shipping charges, where applicable, may be non-refundable except where required by law.

Refunds are issued to the original payment method once the returned product has been received and inspected, subject to the conditions set out in our Return and Refund Policy.

Where MIUUR offers to arrange a return courier service on behalf of the customer, the corresponding return shipping cost may be deducted from the refund where communicated and accepted by the customer.

SECTION 7 – INTELLECTUAL PROPERTY

The Services and their contents, including trademarks, trade names, logos, product names, designs, text, photographs, graphics, illustrations, videos, audio, website design and other materials, are owned by or licensed to MIUUR and are protected by applicable intellectual property laws and international treaties.

The Services are provided for personal, non-commercial use.

You may not reproduce, distribute, modify, publicly display, republish, download, commercially exploit or otherwise use any substantial part of the Services without prior written consent from MIUUR, except where permitted by applicable law.

MIUUR names, logos, product names, designs and other brand elements may not be used without our prior written permission.

Shopify's name, logo and related trademarks belong to Shopify or its licensors.

All other third-party trademarks remain the property of their respective owners.

We may provide access to tools, services or functionality supplied by third parties.

We may not monitor or control such third-party tools.

Third-party tools may be provided on an “as available” basis and may be subject to their own terms and privacy policies.

Your use of third-party services is at your own discretion, and you should review the applicable terms before using them.

We may introduce additional tools, resources or functionality to the Services in the future. Unless stated otherwise, such features will also be subject to these Terms of Service.

The Services may contain links to third-party websites, platforms or services.

MIUUR is not responsible for the content, accuracy, availability, policies or practices of websites or services operated by third parties.

If you access a third-party website or service, you do so subject to that third party's terms and policies.

Any complaint, claim or question relating to a third-party product or service should be addressed directly to the relevant third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

MIUUR is powered by Shopify, which enables us to provide the Services to you.

However, purchases made from our store are made directly between you and MIUUR.

Shopify is not the seller of MIUUR products and is not responsible for the fulfilment, quality, delivery, returns or other aspects of purchases made from MIUUR.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or liabilities arising specifically from products purchased directly from MIUUR.

Feedback must not infringe the rights of third parties or contain unlawful, defamatory, abusive, misleading or malicious content.

You remain responsible for the accuracy and legality of Feedback you submit.

We may restrict or terminate access to the Services where we reasonably believe these Terms have been violated.

Termination does not affect rights or obligations that arose before termination.

Any provisions which by their nature should survive termination will continue to apply.

We aim to provide products and Services that conform to the descriptions and standards communicated on our website.

Nothing in these Terms excludes, limits or modifies any statutory guarantee, warranty, remedy or consumer right that cannot lawfully be excluded or limited.

To the extent permitted by applicable law, we do not guarantee that the website or digital Services will always be available, uninterrupted or completely free from technical errors.

To the extent permitted by law, MIUUR will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.

MIUUR will not be responsible for failure or delay caused by events outside our reasonable control.

This section does not affect your statutory consumer rights.

To the extent permitted by applicable law, you agree to be responsible for losses or claims suffered by MIUUR arising directly from your unlawful use of the Services, your intentional infringement of third-party rights or your material breach of these Terms.

Nothing in this section imposes liability on a consumer beyond what is permitted under applicable law.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted by law or, where necessary, treated as severed.

The remaining provisions will continue in full force and effect.

A failure by MIUUR to exercise or enforce any right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement governing your use of the Services and purchases from MIUUR.

Nothing in this section affects any mandatory rights granted by applicable law.

SECTION 22 – ASSIGNMENT

You may not transfer your contractual rights or obligations under these Terms where such transfer would materially prejudice MIUUR, except where permitted by applicable law.

MIUUR may transfer or assign its rights and obligations in connection with a sale, restructuring or transfer of the business, provided that this does not reduce any mandatory consumer protection available to you.

These Terms of Service and any contract between you and MIUUR are governed by and construed in accordance with the laws of Spain.

If you are a consumer, nothing in these Terms deprives you of any mandatory protection granted to you by the laws of the country in which you habitually reside where such protection applies.

Any dispute will be subject to the courts and authorities determined by applicable law.

For customers who are not consumers, disputes relating to these Terms or the Services will, to the extent permitted by law, be subject to the competent courts in Spain.

Where required by applicable law, we will provide notice of material changes.

Changes will apply from the effective date stated or, where no date is stated, from the date they are published.

Changes will not retroactively reduce statutory rights relating to orders already placed.
