Terms of sale
These Terms of Sale govern purchases made through www.miuur.com. By placing an order through the website, the customer confirms that they have read and accepted these Terms of Sale together with any policies expressly referred to herein.
The seller is Ignacio Cristofori, trading as MIUUR, with N.I.F. Y8130709Q and address at Larrein 6, 01170 Legutiano, Álava, Spain. For any questions relating to an order, please contact care@miuur.com.
Commercial policy
MIUUR sells its products directly to final customers through www.miuur.com.
Customers must have the legal capacity required to enter into a purchase contract. By placing an order, the customer confirms that the information provided during checkout is complete and accurate.
These Terms of Sale apply to the offer, purchase, payment and delivery of products purchased through www.miuur.com.
Nothing in these Terms of Sale limits any mandatory rights available to consumers under applicable law.
Products
MIUUR makes reasonable efforts to describe and display its products as accurately as possible, including their materials, colours, measurements and finishes.
However, colours may appear differently depending on the screen or device used to view the website. Measurements may also present minor variations due to the handcrafted nature of certain products.
Leather is a natural material and may present variations in grain, tone, texture, veins or markings. These characteristics are inherent to natural leather and do not in themselves constitute defects.
MIUUR may modify its product assortment, introduce new products or discontinue existing products at any time. Product availability is subject to stock.
Prices, taxes and duties
Product prices are those displayed on the website for the customer's selected market and destination at the time the order is placed.
Prices may vary between countries or markets as a result of local pricing, currencies, taxes, duties or other market-specific factors.
Any applicable shipping costs, taxes and duties will be communicated to the customer before the order is confirmed, in accordance with the conditions applicable to the selected destination.
Where the website expressly states that taxes and duties are included for a particular destination or order, they are included in the price paid by the customer.
MIUUR may change product prices at any time. Such changes will not affect orders already validly accepted by MIUUR.
In the event of an obvious pricing or technical error, MIUUR may contact the customer before accepting or dispatching the order in order to correct the error. Where an order cannot be fulfilled as placed, any amount already paid will be refunded.
Placing an order
To place an order, the customer must follow the checkout process on www.miuur.com, provide the requested information, select an available payment method and confirm the purchase.
Before submitting the order, the customer will have the opportunity to review the selected products, quantities, prices, delivery information and the total amount payable.
After the order has been submitted, MIUUR will send an order confirmation to the email address provided by the customer.
Receipt of an automated order confirmation does not prevent MIUUR from subsequently contacting the customer if there is a problem affecting the order, including an inventory discrepancy, payment issue, incorrect information or other circumstance preventing fulfilment.
If MIUUR is unable to fulfil an order, the customer will be informed and any amount already paid for the unavailable products will be refunded using the applicable payment method.
Pre-orders
Certain products may occasionally be offered for pre-order before they are available for immediate dispatch.
Where a product is offered on a pre-order basis, this will be clearly indicated on the relevant product page together with the estimated dispatch or availability period.
Estimated pre-order dates are provided in good faith and may be subject to reasonable changes resulting from production, quality control, logistics or other circumstances. If a significant delay occurs, MIUUR will inform the customer as soon as reasonably possible.
Payment
The payment methods currently available will be displayed during checkout and may vary depending on the customer's country, currency or selected market.
The customer agrees to pay the total amount shown at checkout when confirming the order, subject to the conditions of the selected payment method.
Payments are processed through the payment services available through our e-commerce platform and the corresponding payment providers. MIUUR does not require customers to send payment card details directly by email.
Where a payment is not authorised or cannot be successfully completed, the order may not be processed.
Order confirmation and invoice
Following a successful order, the customer will receive an electronic confirmation containing the relevant order information.
Where required by applicable law or requested by the customer, the corresponding invoice or proof of purchase will be made available electronically.
Shipping and delivery
Orders are delivered to the address provided by the customer during checkout. Customers are responsible for ensuring that all delivery information is complete and accurate.
The estimated delivery time applicable to an order will depend on the destination, product availability, carrier and shipping service. Any delivery estimates communicated on the website or during checkout are provided in good faith but may be affected by circumstances outside MIUUR's reasonable control.
Where no specific delivery period has been agreed and mandatory consumer legislation applies, delivery will take place within the period required by applicable law.
MIUUR shall not be responsible for delays caused by incorrect or incomplete delivery information provided by the customer, unsuccessful delivery attempts attributable to the recipient, customs procedures outside MIUUR's control, carrier disruption, force majeure or comparable circumstances, without prejudice to any mandatory consumer rights.
Where a shipment is returned to MIUUR because delivery could not be completed for reasons attributable to the customer, any costs associated with returning or reshipping the order may be charged to the customer to the extent permitted by law.
If a shipment is confirmed as lost in transit, MIUUR will work with the carrier and the customer to provide the appropriate remedy, which may include replacement or reimbursement depending on the circumstances.
For further information, please refer to our Shipping information.
Inspection upon delivery
Customers are encouraged to inspect the parcel and product promptly after delivery.
If the parcel arrives visibly damaged, or if the product has been damaged during transport, the customer should contact MIUUR at care@miuur.com as soon as reasonably possible and provide photographs or other relevant information so that the matter can be investigated.
Failure to notify MIUUR immediately does not affect any mandatory statutory rights available to the customer.
Right of withdrawal
Where the customer qualifies as a consumer and applicable law provides a statutory right of withdrawal, the customer may withdraw from the purchase within the legally applicable period.
For consumers covered by Spanish and European Union distance-selling rules, this period is generally 14 calendar days from the day on which the customer, or a third party designated by the customer other than the carrier, receives the goods.
To exercise the right of withdrawal, the customer must clearly communicate the decision to withdraw within the applicable period by contacting MIUUR at care@miuur.com.
The products must subsequently be returned within the period required by applicable law.
Unless MIUUR expressly agrees otherwise, the customer is responsible for the direct cost of returning products when exercising the statutory right of withdrawal, to the extent permitted by applicable law.
Products must be returned with reasonable care. The customer may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product, as provided by applicable law.
Any statutory refund will be processed in accordance with applicable consumer law and, where required, using the same payment method originally used for the transaction unless otherwise agreed.
For practical instructions and the conditions applicable to returns and exchanges, please refer to our Exchanges & Returns policy.
Exchanges
Where MIUUR offers exchanges in addition to the customer's statutory rights, such exchanges are subject to the conditions stated in our Exchanges & Returns policy.
An exchange offered as a commercial service does not limit or replace any statutory rights the customer may have in relation to withdrawal, defective products or lack of conformity.
Defective products and statutory guarantee
Consumers are entitled to the legal remedies available under the mandatory consumer protection legislation applicable to their purchase.
For purchases subject to Spanish consumer law, MIUUR is responsible for lack of conformity existing at the time of delivery and manifesting within the statutory period applicable to new goods, currently three years from delivery.
Depending on the circumstances and applicable law, the customer may be entitled to remedies including repair, replacement, a price reduction or termination of the contract.
Damage resulting from misuse, accidents, inappropriate storage or care, normal wear and tear, or alterations made by the customer or a third party is not considered a lack of conformity attributable to MIUUR, except where applicable law provides otherwise.
The natural variations of leather and other natural materials described in the relevant product information are not considered manufacturing defects when they are inherent characteristics of the material.
If you believe a product is defective, please contact care@miuur.com with your order details and photographs of the product so that we can assess the issue.
Promotional codes and offers
Promotional codes, discounts or special offers may be subject to specific conditions, validity periods, eligible products or markets and availability.
Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be combined with other promotions.
Any additional conditions applicable to a particular promotion will be communicated together with that promotion.
Personal data
Personal information provided in connection with an order will be processed in accordance with our Privacy Policy and applicable data protection legislation.
Personal data may be processed where necessary to manage orders, payments, delivery, returns, customer service, fraud prevention and compliance with legal obligations.
Changes to these Terms of Sale
MIUUR may update these Terms of Sale from time to time to reflect changes in applicable law, business operations, website functionality or commercial practices.
The Terms of Sale applicable to an order are those in effect when the customer places that order, unless a subsequent change is required by mandatory law.
Applicable law and jurisdiction
These Terms of Sale are governed by Spanish law, without prejudice to any mandatory consumer protection rights that may apply to customers in their country of residence.
Any dispute arising from a purchase through www.miuur.com will be submitted to the courts or dispute-resolution bodies having jurisdiction under applicable law.
Nothing in these Terms of Sale restricts a consumer's right to rely on any mandatory jurisdiction or consumer protection provisions applicable to them.
